OBJECTIVES
The Graduate Program in Law at UniBrasil aims to foster ongoing research into the possible relationships, connections, interdependencies, and intersections between fundamental rights and democratic theory. This critical mission, which prioritizes the advancement of the Democratic Rule of Law, defines fundamental rights as an unsurpassable civilizational benchmark and the starting point for understanding the democratic principle as the foundation of legitimate political organization, both within nation-states and in supranational political communities.
Contemporary history demonstrates that the full potential of fundamental rights theory—their effectiveness and scope—cannot be substantially realized without preparing a space for democratic legitimacy. Furthermore, it necessitates an inevitable dialogue between the theory and practice of fundamental rights, as the full realization of democracy requires the implementation of constitutional and international instruments capable of transcending the mere declaratory function assigned to normative frameworks.
Thus, the expansion of the ownership and exercise of fundamental rights is essential to the effectiveness of the democratic principle. The importance of studying this theme is evident both within nation-states and in supranational and international communities. At the national level, the development of constitutionalized policies to uphold fundamental rights and the experience of political discourse in democratically legitimate spaces highlight the inseparable link between understanding and interpreting fundamental rights, even in contexts of democratic deficit. Conversely, in supranational and international organizations, the prioritization of fundamental rights—achieved through dramatic struggles—creates a democratic deficit through intergovernmental mechanisms, varying in severity (e.g., greater in classical international organizations, lesser in the European context, where supranational citizenship has emerged).
To anchor this broad study, the UniBrasil Graduate Program in Law focuses on the concentration area Fundamental Rights and Democracy, divided into two research lines:
1. Constitution and Material Conditions of Democracy
2. Jurisdiction and Democracy
All research conducted within the program, particularly within its core groups, aligns with this overarching proposal and its research lines.
In addition to promoting legal scholarship, the program aims to prepare qualified educators for higher education in this field—professionals capable of training new researchers and practitioners committed to advancing fundamental rights and democracy.
To fulfill its mission, the UniBrasil Graduate Program in Law has established agreements and partnerships with numerous national and international institutions.
